Collection, use and disclosure of personal information

For the purposes of this Appendix, the term “Merchant” refers to 13440222 Canada Inc., its successors and assigns.

The term “I” means each individual who has applied to the Merchant for an open credit facility through this application.

Collection

The Merchant collects personal information about me through technological, electronic, or telephonic channels as applicable, for the purposes described in the “Use and Disclosure” section below.

I consent to providing the Merchant with the personal information about me that is necessary for these purposes, and I authorize the Merchant to obtain personal information about me from personal information or credit reporting agencies, financial institutions, and personal property registries, as well as from my current and former employers, professionals, and other persons I have designated as references in my application.

The personal information collected by the Merchant may include the following:

(a) my surname, given name, contact information (residential address, email address and telephone number), date of birth, source of income, occupation, employment status, employer, date of hire, gross income, monthly housing costs, total monthly payments for consumer loans and long-term leases, and bank account information;
(b) identifiers I have disclosed to the Merchant in this application, including my social insurance number if I have chosen to disclose it to the Merchant; and
(c) recommendations and information contained in credit reports obtained by the Merchant from personal information or credit reporting agencies.

Use and Disclosure

  1. The personal information collected by the Merchant may be used and disclosed to the extent necessary for the following purposes:
(i) to assess my financial situation, to determine my eligibility for the products and services requested and to verify the accuracy of the information provided;
(ii) to provide me with services related to the issuance of an open credit product, to understand and meet my needs with respect to such services and to protect my interests and those of the Merchant;
(iii) to allow the Merchant to manage its business and to comply with its legal obligations;
(iv) to disclose my information to any service provider of the Merchant for use by such service provider to the extent necessary to provide these services, including for data processing and storage, as well as for collections and transaction monitoring to protect me against errors and fraud;
(v) to facilitate my identification and to distinguish me from the Merchant’s other customers, when dealing with the Merchant, personal information and credit reporting agencies, financial institutions, personal property registries, my current and former employers, professionals, and other persons I have designated as references in my application. If I have chosen to disclose my social insurance number to the Merchant, the Merchant may use it only for these specific purposes;
(vi) to disclose my information to prospective purchasers, investors, or transferees and their representatives, in connection with the sale, assignment, or other transfer of the Merchant’s business, so that they may assess and complete such transactions; and
(vii) to disclose my credit file to personal information and credit reporting agencies.
  • The Merchant may also use my personal information to manage and improve its business, products and services, for statistical purposes, or to assess the quality of its customer service. For these purposes, the Merchant may, from time to time, record or monitor telephone conversations with me. I understand that I may withdraw my consent to these uses of my personal information by contacting the Merchant as set out below or by refusing to consent to recording or monitoring during a telephone call.
  • My information may be transferred outside my jurisdiction for the purposes described herein and may become subject to the laws applicable in such other jurisdictions.
  • Personal information about me will be accessible to employees of the Merchant and its service providers who require it in the course of their duties, to the extent necessary for the purposes described herein. The Merchant will retain my personal information until the purposes for which it was collected have been fulfilled or the information is no longer necessary for such purposes, and for any additional period required to comply with its obligations under applicable laws.

    I understand that I may submit a written request to access and receive a copy of the personal information about me held by the Merchant, and to request that such information be corrected, as well as to receive information regarding access to and correction of records held by the personal information agency from which the Merchant has obtained a credit report or recommendations concerning me, by contacting the Merchant by telephone at (647) 869-8862.

    I expressly consent to the Merchant collecting, using and disclosing my information in the manner and for each of the purposes set out above. Without limiting the generality of the foregoing, I specifically consent to the Merchant obtaining, from time to time, credit reports or recommendations about me from personal information and credit reporting agencies, and I acknowledge having been duly notified of this. I understand that I may withdraw my consent, but that the Merchant may then no longer be able to provide me with the services requested.
